A sale built for this situation, not adapted from a standard one
A divorce home sale is managed as a neutral sale, with a written plan, agreed pricing and communication steps, and the same updates for both parties.
Selling a home during divorce adds legal timelines, paperwork, and real emotions to an already big moment. It is one of the hardest sales there is, and it is exactly the kind of sale a Certified Divorce Real Estate Expert is trained for. Staci Wolff, CDRE, works with divorcing homeowners across Hawai'i. Her job is simple to describe and serious about keeping: protect the equity you have both worked for, keep the process neutral and on schedule, and get both parties to the same closing table with care, not chaos.
What makes this sale different
Neutral from the start. The agent works for the sale, not for one spouse. Written agreements come first: who decides on price, offers, and repairs, and how ties get broken, so nothing is argued mid-stream.
Same information, same time. Both parties get the same written updates at the same time. No side channels, no surprises.
Two timelines, tracked together. Divorce-case deadlines and contract deadlines are managed side by side, so a court date never blindsides a closing date.
Equity first. Price from comparable sales, small prep that pays, written proceeds instructions early, so closing day holds no surprises.
The process, step by step
1. Before you list. Talk with your attorney about timing, does your case set deadlines for the sale? Agree in writing on decisions and on who covers carrying costs. Set one communication channel, with both spouses copied. Gather the paper trail: mortgage statement, HOA documents, insurance, any liens or equity lines. And get a data-based valuation before anyone names a number, anchor on the market, not on feelings.
2. Protecting your equity. Price from comparable sales, not from what either party hopes or needs to walk away with. Do the small prep that pays, deep clean, declutter, minor fixes, and skip big renovations mid-divorce. Agree in advance on how offers will be judged and how fast you will respond. Give escrow and title written instructions on proceeds early.
3. While it is on the market. Expect a weekly written update to both parties, showings, feedback, next steps. Communication runs through your agent so the contract stays neutral and on schedule. Move-out and the personal-property split are planned before closing week, not during it.
4. At the closing table. Proceeds instructions are confirmed against your written agreement. Payoff figures for the mortgage, equity lines, and liens are verified a week before closing. The signing plan is known ahead of time, together, separately, or remote. After closing, keep your settlement statement for your records and your tax professional.
